Rules

It is essential for both KidsFunBus.co.uk (KFB) and you, the hirer, to understand what is expected from each other. So for the purpose of this document the following interpretations apply.

 

Hirer

 

This is the person who hires the bus on behalf of themselves and all members of a group. The Hirer is the person who makes the booking.

 

Seller

 

KFB agrees to sell our services to the Hirer subject to all the Terms and Conditions.

 

Booking Request.

 

Once KFB have responded to the hirers booking enquiry, if the hirer wishes to book the bus, they will need to supply all the required details and pay a 15% deposit.

KFB guarentee that once a deposit is paid, the slot will not be offered to another private hirer.  

However bookings made over a month in advance may be subject to alteration if a full day booking for a major event comes in. 

This rarely happens, but if making a booking over a month in advance, the hirer needs to know it is a possibility.

KFB will do everything possible to find an alternate date, or offer a full refund.

 

Vehicle

 

The converted bus used to provide the service to the Hirer.

 

Staff

 

The Driver and Party Hosts that are working for KFB. 

The Driver will have responsibility for the safety of the vehicle.

The Party Host(s) will have responsibility for the safety of children whilst on the bus, and their instructions must be adhered to by the hirer.

 

TERMS AND CONDITIONS

 

The Hirer agrees to inform all members of the group that the event is booked, and of all the terms and conditions, and agrees to ensure that the conditions are adhered to.

 

A booking is made and a contract formed when KFB receives a booking request and a 15% deposit is paid.

Bookings made over a month in advance carry a slight chance of alteration if a full day booking for a major event comes in.

The deposit is normally non-refundable, unless KFB are able to hire the bus out eleswhere at the same date / time.

 

Once KFB have received the booking request and deposit, we will confirm your booking, along with an invoice for the balance payment.

The balance must be paid at least 10 days before the booking date.

If you do not pay the balance by the due date, KFB, will be entitled to regard the booking as cancelled and no refund will be payable.

 

 

OPERATIONS

 

KFB will not take responsibility for any delay in reaching any venue due to road works, traffic chaos or any other highway hazard. 

If the bus is delayed, it will, if it's timetable for the day permits, still stay for the agreed time period.

However it is always our aim to arrive at your venue 15 minutes ahead of the scheduled time, so giving a margin for the unexpected.

 

When the bus is booked for a private event the price quoted will include parking, if appropriate.

 

HIRER

 

The Hirer will be responsible for any damage caused to the vehicle by any member of the Hirer's group.

The Hirer will also be responsible for any damage caused to the interior or exterior of the vehicle as a result of incitement.

You also have to ensure that you and your group do not behave in such a way that puts safety to others at risk, or damage to the bus may occur.

You may not eat, smoke, or drink on the bus. For a private hire, food and drink are allowed subject to agreement with KFB. Chewing Gum is forbidden.

No Animals are allowed onto the bus at any time.

The Hirer is responsible to ensure that everyone in their party wears suitable clothing.

The Hirer must ensure that all necklaces, chains and any other jewellery are removed from all party members before playing.

  

SELLER

 

Safety is our paramount concern, therefore if any of our staff see members of your group jeopardizing our safety policy they will be entitled to remove them from the bus and those people will have to make their own way from that point. No refund will be due.

Anyone behaving in a careless or irresponsible manner which might cause an accident will be suspended.

The Seller does not accept responsibility for any loss, damage, inconvenience, injury or death arising from any accident, breakdown or delay attributable to reasons beyond the control of the seller.

KFB cannot be responsible for any valuables.

KFB asks that no members enter the play bus until requested to do so.

All complaints are taken very seriously and must be put in writing to

MISCELLANEAOUS

 

M1:The Seller will not be liable (other than liability for death or personal injury resulting from the Seller's negligence) for loss, injury or damage caused by third parties provided by the Seller where such loss, injury or damage arises from the act of omission of the third party.

M2:The Seller's liability to the Hirer (other than liability for death or personal injury resulting from the Seller's negligence) for any loss or damage of any nature: (a) arising from any breach of the Conditions; or (b) any negligence, breach of statutory or other duty on the part of the Seller; or (c) in any other way out of or in connection with the non-performance of or purported non-performance of, or failure to perform the Services in accordance with the Conditions will be limited to no more than the total cost of the booking.

M3:The Hirer is not permitted to cancel this agreement except with the written consent of the Seller. Subject to the seller giving permission for the contract to be cancelled the following fees apply:- cancelled more than 21 days before the booking date refund of booking less deposit. Cancellation within 21 days of the booking, no refund will be due unless agreed with the seller.

M4:The Contract is between the Seller and the Hirer as principals and may not be assigned by the Hirer without the express written consent of the Seller.

M5:These Conditions form the whole agreement between the Seller and the Hirer and shall not be removed or varied in any way.

M6:The Seller is in default of any of its obligations hereunder, it shall not be liable where such default is due to any act of God, war, strike, lockout, industrial action, fire, flood, drought, tempest, snow, mechanical breakdown or any other event beyond the reasonable control of the Seller. In such circumstances, the Seller shall give notice to the Hirer where possible, and be entitled to retain the initial deposits and be released from performance of its obligations hereunder to the extent the event of supervening impossibility prevents or restricts the Seller's performance.

M7:These Conditions are subject to English Law and the Hirer consents to the exclusive jurisdiction of the English courts in all matters regarding the Services.

M8:It is not the intention of the parties to confer any rights contained in The Contracts (Rights of Third Parties) Act 1999 on any third parties referred to here herein, and any such rights which may otherwise be implied are hereby excluded.
